Yes, I think it very accurate saying justice is blind. Along with that should be added that guilty or not guilty has no bearing what-so-ever! The hard fact, known by all, is that the results of a jury trial are not necessarily based on the true facts. In reality, true facts only serve as the core for any spoken. When two lawyers get before a judge and twelve of our peers, in a very short period, the facts get so beaten up that neither the judge nor the jury have any idea of the truth. Justice as far as being the quality or state of being just and unbiased is not! Justice is what the party with the best and most believable skewer of facts call it while the other party can only call it getting screwed.
Speaking of peers! I was 31 of 54 and made the mistake of wearing my glasses so I wasn't chosen. But what a diversified bunch we were. I don't want to sound high-falutin' but golly gee some of the others as my peers worries me quite a bit should I ever need a jury to decide for me. Thinking about what I just typed wouldn't apply if I had the best lawyer because some of my peers really did look gullible. I noticed a few made the cut too.
The plaintiff and the defendant were both from California, Missouri and each had two lawyers of which all were from Columbia. I went back to hear the openings and stayed for the first witness which was the defendant.
My short summarization is that a couple of inebriated women went out into the country to fellow friends house after midnight to visit. The one driving didn't want to leave as soon as the plaintiff so the plaintiff left the house to wait in the car. When the driver went to the car she found the plaintiff face down and unconscious beside the opened passenger door. The driver called out the man of the house and after the plaintiff regained some consciousness and threw up a couple of times, proceeded to help load her into the laid back passenger seat of the car. The driver took her home where an ambulance was finally called to get her out of the car and to a hospital.
The plaintiff ended up in the hospital for over three months because of a spinal injury and is now pretty well handicapped. She is suing the man of the house for the spinal injury that is said to have occurred when he put her into the car. This all happened in 2002 and I'm pretty sure there is a huge amount of money involved. I suspect the defendants legalist are hired by the insurance company and think the plaintiffs legalist are in for a cut of the possible proceeds as she didn't look like a person able to fund the process. I saw the little beat up car she was driving.
To find a sick and inebriated woman beside a car in front of your house wanting to go home, what would you have done? The trial may take three or four days and I'm sure lots of other stuff will come out so there is no way for anyone to judge from here who might get the justice and who will be the screwed. but I'm positive justice will be served.
Justice is only a commodity which is a more or less adulterated condition the State sells to the citizen as a reward for his allegiance, taxes and personal service.~ DD

I'm outta here heading for Versailles to see if they want me to play a part for justice. I've been on juries before and none of them caused much of an appeal to build for the want of another.
The temperature is 37 right now so even tho its raining a bit snow shouldn't hinder my leisure ride any but the rain may cause the glasses to become a necessary apparel. Might need them in the court house anyway......or not.

After I wake, open my eyes and prior to arising, I blink a few times while the realization that the good Lord has granted me another day soaks into my still muddied mind. While still lying there I say a small prayer with 'THANK YOU GOD' being the hub. After accomplishing the getting up feat I usually feel the need to pause for an addendum to the prayer and ask for His help in enabling my old, over used, overweight, creaky and achy body to carry me thru the fine day that He has seen fit to bless me with. Grunts and groans, partly caused by the bones, will never be what kills me.

Had a few flurries here last night after dark. A few flurries of affection that must have gotten too warm because they seemed to have melted by bedtime. Then this morning there was evidence of some snow flurries laying about but they have since melted away too. One would think that a few flurries would be an good indication of a snowing or whatever but tisn't always the case. I have my Via......I mean snow shovel and boots all laid out because I know it will all come sooner or later.

Up at 5:00, headed for Eldon at 6:00, picked up the couple deals that we went for and was back home a little after 7:00. NO SWEAT! The crowd wasn't all that massive or pushy there so things were cool and went along just fine. Cool and no sweat are a couple of facts that our outdoor temperature of 27 degrees contributed highly to.
Now it may be a fireplace lighting laze around kind of day. Or the ease of the shopping during our quick trip to Eldon could have left Dory with an unfulfilled hankering that might possibly lead us..... her to the stores in Osage Beach. In our years together I've grown to realize that she suffers somewhat with a touch of the sadistic personality disorder but when it comes to shopping and probably a few other things, a little masochistic behavior seems to rise above the other. Oh, what would we be if we couldn't be us?
By the way, game time tomorrow for what the newspaper called, "the Armageddon in Arrowhead" is scheduled for 7:00 pm. The paper also reported that some tickets on Ebay are priced over $2,000 for the highly harped University of Missouri game with border showdown opponent Kansas. I can't imagine! It will be shown on ABC and a lot warmer and comfortable seat with replays and many more pluses await those who are savvy enough to use a remote.

Coolest day so far this year according to my observations, 31*. No snow around here but I think there was in northern Missouri. Yesterday was the 24th, does that mean Missouri will get 21 snows this year or just that northern area? Going to be pretty cool tomorrow too but with the many available hot deals in so many stores the cold probably won't be too noticeable for some.
Heading for Ashland pretty soon for the gathering at Dory's nephews. Taking along a pumpkin pie, pecan pie and some sort of sweet potato casserole with pecans that Dory slaved over a hot stove to prepare yesterday. We'll stop by as we go thru Jeff City to pick Lena up then not too far into the afternoon this turkey will get stuffed.
Would a huge hot meal like we'll have be called cool in this day and age? A whole lot of things today just doesn't make any sense to me. Like, you know what I'm sayin?

A rather misty cool morning here. May even have some rain mixed in. Later today some sleet and a little snow is said might come to be but it didn't sound like anything we need to worry too much about. I suppose tho, if a person should be prone to worry this would work better than a lot of other things.
The tree trimmers left one tree trunk that had one of the guy wires to the satellite hooked around it. I changed the wire to the garage roof the other day then yesterday cut the trunk down. It was about 6 feet long and was just within a couple of pounds being more than I could handle. I was able to get it into the pickup bed but it was too long to allow the rear gate to come up and be latched. No problem with that unless it slides out going up the hill to it's hand picked destination. IT DID. I'll find someone to help me load it again one of these days. Or I guess I might cut it up where she lays. Dory wants a few pieces of fireplace wood for this winter anyway.

A laze around day is the thought on my meager mind but.......subject to change is a half second as Dory hasn't come down the stairs yet. Whatever she might spew I think I can fake it till Ruthie comes to pick her up. They have riches on their mind for today. I believe they get to feeling pretty good and take the trip to the boat where the usual loss can bring them back down to normal. I can't imagine what the results of winning might be but doubt if I need to worry about that very much. I really do think it will happen one of these days. That might be some time in the future and I don't think the OATS bus goes there. I guess there will always be a younger idiot wanting to go that could drive them.
At least it is less expensive than all those winters living in Boulder City where we would both go to one or more of the sinful parlors everyday.

I've heard is said that variety is the spice of life and if that's so it is sure going to be very spicy around here for the next several day if not for the whole year. 54 this morning at 5:15, 61 at 9:00 and the mid 70's today and tomorrow came right out of the weatherman's mouth this morning. He also added that Wednesday we would be lucky to get out of the 30's and a good possibility of some mushy snow accumulation after we hit the hay Wednesday night. I suppose it could get so spicy as to keep us home Thursday instead of pigging out at Dory's nephew and wife's house with the rest of the family.
We don't care so much as to what weather we get as long as we pause and take a little time to count our blessings. There are far too many of those to allow such an incidental thing as the weather to have very much of a damping effect. Like Minnie Pearl used to say, "we're just so proud to be here". And also awfully proud that you still are too, wherever you might be!

Dory burned around two million fallen tree leaves yesterday and I hept. I didn't really count them so more than that is a good possibility. The rotten wind would come and go and we never knew from which direction the next puff, puff, puff would come from. Caused us to burn only a little at a time to keep the fire low and containable. Took almost four hours but we burned the lot of them. We still have another several million strewn about here and there and 'too windy' is the only excuse I can come up with to avoid ourselves from becoming totally burned out by burning leaves.
Even with all the burning we found time to watch Missouri win another football game. Afterwards we turned to the Busch race. Dory read and watched it upstairs while I read and watched it for awhile downstairs. I finally decided the book was the better time user and the race was interfering with that delight so I turned the TV off. Dory has it slimmed down to only about 27% of the time but even at that I'll count my blessings and hang on to the slim thread allowed me, the downright wonderful feeling that I can be the judge of how I want to use my time....some of the time! I didn't take into account any doctor or dentist appointments because there we still retain the, go or not, call.
No Dory and I weren't fighting, her favorite chair is upstairs and my is downstairs. There no way could we put them in the same room, GEE WHIZ, they don't come close to matching! Anyway, the way it is, works just fine for us.
The NASCAR season is just about to end and I think my interest in watching beat their ending by about three or four weeks. There is a race today which I'm sure we'll watch but if this new book has it like I hope, I'll use the TV remote delete button. They spell delete- O F F -on the remote.

I'm sitting here with the laptop trying to get my heart to slow down. I'm not sure if I'm having one of those panic attacks that they were talking about on TV this morning or some other kind of heart problem. I think it must have been caused by the very humid air escaping from the shower stall. I had forgotten to take my knife and keys from the other pants when I dressed this morning so went up to get them. Just as I stepped into the bathroom to say something to Dory she turned the shower off, opened the door and stepped out. Good Grief! It literally took my breath away and shifted my heart into such a very fast speed, one that I didn't even know it was still capable of. Along with that, my legs began to quiver and a few odd reactions from some of my other body parts. All this caused me to realize I had to get away from all that humid air as soon as I could. Came down here for some drier breathing which I'm sure will slow my heart back down, tho it hasn't yet. Wouldn't you know it? I forgot my knife and keys too. Guess I'll wait for some of the humidity to dissipate in there before I go after them again.

Well shucks! It might be that a calibration is required for our outside temperature sending devise. Early it showed 39 then went to 37 for a short before it went up to 40 but.......we have frost on our roof. Here, being about as Missouri as you can get, I still want to type that "something is rotten in Denmark". I have a strong feeling that a calibration isn't possible. I suppose I need to scrounge around for a plan B of some kind. We listen to the TV every morning, guess we can accept their word when they say "at the lake" then spouting a number.

Poor dumb/smart Mikey. The other day as he and I headed out up the steps and as my head cleared the stoop my eyes picked up on the little skinny 18" garter snake that hangs around here all the time laying all stretched out there. Mikey sashaying up the steps beside me didn't see the snake and stepped on it. When I hollered Mikey stopped and just stood there with two of his feet on the snake. I got too huffy trying to get the Mikey to move and he feeling like I was going to beat him because of the gruff words, laid down on the snake. I rushed on up the stairs and onto the road calling Mikey to come with me which he did. He didn't get bitten and as far as I know the snake may have appreciated the temporary warmth Mikey provided. When we returned from our short walk the snake had slithered off somewhere out of our sight.

Was 57 degrees at 5:15 but by 7:00 it was down to 54. The sun and clouds are playing peek-a-boo with us as the wind continues to unclothe the trees. I'll say the limbs that the wind undresses aren't a very pretty sight either.
Didn't go with Dory yesterday and the way her day progressed she was glad I didn't. A two hour wait at the doctor and a rotten but sort visit at the boat where she didn't even get to eat. Told me that was her main goal but Lena decided she wanted McDonald stuff before they got to the boat. My happiness to see her back home alive didn't do much to pull her out of the doldrums. Imagine that, pretty odd isn't it?
I may take her out somewhere today and feed her a good store bought meal. Too bad but I think McDonalds won't make the possible list.
I've got to give this up. The darn cat won't leave me alone this morning. I think the little neutered guy is trying to hump my arm! Dory bought me a new kind of aftershave, do you think that could be the reason? I might better wash it off before going out in public. Wouldn't want pussy cats climbing all over me every where we go.

Ain't got time to oil the hinges, nor to mend no windowpane because Dory is going with her mother to Columbia for a shot that might ease some of the leg pain and I'm thinking about going with her. Only the shadow knows what might be done once we're both out of this house and only 20 minutes away from Booneville and it's sinful gaming boat. Problem asking the shadow so far this morning, he can't be found as it is so cloudy it looks dark out. Maybe it is still dark out? What the hey, most everyone likes surprises.
We've received about 1.1 inches of rain so far and tho it's cloudy we're told the raining has finished. You know if you hear it on a radio, TV or read it in print somewhere it has got to be a fact. But.....but once you hear it don't turn the knob to a different station or if you read it don't pick another source to read it again because it's quite possible the views won't coincide. Your easy ride could become complicated as you'll be left standing there with the chore of making a decision. Golleeee gee, we all have enough problems without adding another. Like some others, I think I'll take the easy way, hook my finger in the belt loop and follow that goat to where ever.

Wowee damn! A typical knee jerk reaction from a hard nosed Democrat friend to an innocent forward with a political slant that differed from their tainted opinion. Matter of fact I was told never to send another one! Now isn't that just peachy? A really nice person that evidently doesn't have any idea how to click the delete button, took the time to tell me they have no desire to ever peer around the self imposed blinders that evidently has been worn for so long they are a permanent fixture. The note also stated that they can still READ AND THINK FOR THEMSELVES which causes me to wonder, what the hell did I do wrong. Evidently I have been mistaken most of my life in thinking that to form a complete and a more correct opinion, one must accept and consider other sources even tho they may lay to either the left or right of the blinded sight.
I'm fighting to keep this last reaming from making me a bigger asshole but it sure is a struggle. I'm also fighting the message's inferred notion that any conversation or communication that might happen between us in the future will not be wanted at all if it doesn't fit into the view between the blinders. There is no delete button that can be used in a direct person to person interaction other than ignoring some of the said words but there sure as heck a delete button on everyone's computer. I think it would be a lot less stressful world if everyone would acclimate themselves to where that flusher is located then use it! I would highly recommend that if you think something is crap, use that beautiful delete button and flush it. I don't think it is possible, so only a waste of time and unnecessary aggravation could result from trying to poke it back up the asshole that sent it to you.

A real hearty day in the making here. The clouds with the fall foliage is my kind of weather and beats my heart good while at the same time it is very warm which appeals to Dory's thumper. Plus, haven't seen but two fishing boats all morning. Another good day in the life of these two poor lake bank dwellers.
I don't think that anyone should draw a line down a piece of paper and then list all the days foreseeable positives on one side with a list of possible negatives on the other to determine what kind of day one will have. There are always a lot of choices in a day's time and it usually doesn't take an Einstein to determine the happier one. Bleak as any negative might be there will always be a positive floating in it somewhere. A person just needs to take a few seconds to find it then skim it as your choice then dance along to the next.

Woe is me could be my theme here if I wanted to turn loose and just take the ride. I was born big and too heavy and have somehow managed to stay that way all my life. My poor regular sized joints being forced to carry all that ultra extra weight and encouraged by old age seem to have begun protesting their long overused abuse and the protests keep getting longer and more often.
Most of the protests I can mostly ignore and go on about my business but some hurt me some while some just aggravate me. The most hurting one is after looking forward to bed and the soothing mind cleansing that sleep usually brings and then the hurt begins when my back starts protesting any and all the prone positions I can achieve. This surely does cause some of the wished for soothing to come up short. We've tried different beds but to no avail. It certainly isn't something I can't live with.
One of the aggravations is the fact one knee cannot have any weight put on it nor anything pushed up against one area without a severe burning sensation. One of our nice doctor neighbors told me the old joint was letting some of my knee juice ooze out. I still do what I do and some require me to be on my knees. Have you ever tried doing a job requiring you to get on your knees and find you're not able to use one of them? What a mess! What I have been able to do so far is to lay completely down to do the chore which has worked just fine for some time now.
What I want to ask, can you imagine the struggle to get a big assed overweight body off the floor, dock, porch or where ever you were forced to lay it and using only one knee? I can do it! Barely maybe but I'm damn sure not going to hang around here just for the ride! Woe is not ever going to be me.

I can't remember what caused me to wonder about the earth's rotation but I did and spent several minutes looking for an answer. Finally found one....I guess.
Answer: The apparent motion of the Sun. If the Sun SEEMS to move around the Earth counterclockwise, but actually the Earth is the one moving around the Sun, is the Earth's motion clockwise or counterclockwise? You need a sheet of paper to solve this problem, which is also problem #1 among the ones listed in "Stargazers." But I won't keep you in suspense: it is ALSO a counterclockwise motion.
After the answer another question popped up but I pricked it and sizzled it down to hardly a wonder. "If we had never had clocks, what words would we use to describe the direction of the earths rotation?" Yeah right, who cares.
Yep, another typical daily catch for me. I think it is about the 310th time this year that I've sat down here at the computer and was caught with nothing worthy to type about. I can't remember ever typing a worthy note but just assumed that I may have flittered my three typing fingers across the key board and lucked out with something worthy to someone at least three times during the year. Some may be able to call me on that but what the hey, right or wrong that's my song. Yeah right, another who cares.

I know mother nature had a plan for the leaves that she had worked out would give up the mother ship and fall every year with the oncoming cooler weather. The leaves, a must for the survival of the tree that grows it, but I don't think it quits working for the mother when it falls off. I suspect it had a job of keeping the base a little warmer in the really cold of the winter as well as adding nutrients back to the soil as it decays. Probably replacing some that mother's roots sucked up during the summer.
If I was the chief cook and bottle washer there by awarding me the supreme right to make every decision around here, I would allow nature it's due course. It isn't so much the labor but because I've become so soft hearted in my older years that I can't bear the thoughts of shooting wild game of any kind and the softness runs on over into thinking all nature things should be left to their natural span. Oh, I almost forgot another contributor, gasoline for the blower is now $2.949 per gallon and I'm needing some.
Who knows? The tree that we had removed recently may have died because of our taking away its warming nutrient makers every fall over the past 14 years.
Dory has her day scheduled to accommodate a trip with her mother to Columbia for a doctor's appointment while my assigned task is to stay here and work on the dratted leaf removal project some more. If it isn't too windy a leaf burning will occur. I'm thinking I ought to burn them where thy lay, saving oodles in the use of that expensive gasoline. I could or probably would cut all the house cleaning chores to one last time at a couple or three homes that being as the wetted burned out shells are loaded into trucks for hauling off.

GREAT NEWS! Here, we both were blessed to awaken to another day as I suspect if you're reading this you did too. Another great news item from here should also include Dory passing all her doctor given health tests after which they both proclaimed her to be doing great, then arranged to see her again in six months. So good for one of the doctors that he stated his nurse would probably be the one to conduct the interview etc. at the next visit.
A bit of cold crept in on us last night so as to be here to greet us at the start of our new day. As it goes, 34 was as low as it got so we have yet to see any frost in our immediate area. Only happens on a Sunday! I'm typing about any problems that might require a technician such as our refrigerator which probably quit sometime Saturday night but wasn't discovered until early Sunday morning. Unbelievably a repairman called this morning said that he would try to be here in a hour. Of course that remains to be seen.
People along with us, take so much for granted that trying to find a plan B or C to keep foodstuffs cold is a stunner. The tiny little refrigerator downstairs just doesn't hold very much. I guess it was about time to clean the larger side by side six years accumulation out of the old fridge anyway. It is a Maytag. Maybe that is why the repair man can come so soon. He didn't have anything else to do.
Wooee, I remember several years ago when the deepfreeze quit. Didn't notice that for several days and the mess there was terrible. Half full of bloody water with a gag triggering stench emitting from it. I had to put a large potato chip clip on my nose an then wasn't able to give Dory as much help as I should have.
My life has been filled with terrible misfortune; most of which never happened.~Montaigne

Ha, didn't change or clocks last night so ended up rising at 4:00 am. I did change all 19 of them this morning. I hardly ever know what day it is but I can always tell you the time.
Dory says it is going to be a long day!
I may un-battery the boats today. Bring them to the garage and charge them up for the winter. Never did get around to using the bass boat again this year. I believe this is the third or fourth year that we failed to even try starting it. Can't help but wonder a little bit if it will ever start since laying around so long. Maybe I'll try it come spring.

We haven't been getting a lot of rain but I guess there is enough moisture in the air because something is causing all the tree leaves to turn rusty. There is a lot still hanging on the trees so I've not had to move the whole five million yet. It does seem like every time you relocate the fallen they get replaced before you can put the blower away. What a dandy world out here in the country amidst all these trees less one.
I don't know if our temperature relating device is always wrong or if the television and radio people have it wrong but we have yet to show anywhere near the temps they tell as down at the lake. We normally show from six to ten degrees warmer than what is said. We must be on the warmer side of the lake. As the crow flies we're only about 5 miles from Lake Ozark. Unbelievably, this morning we were only two degrees warmer than stated.

A word by my hand isn't worth as much as two blank spaces but no one is paying me for the time I lose struggling to type something. So no loss here. It is probable that someone reading the words might have a large value on their time which could then account for a loss but I'm not going to worry about it.
You know every living thing has the same amount of time until they aren't anymore. I suppose the only way to determine the value of ones time would be to base it on how much they are getting paid for it. But.............even that would be based on what you do with your time, leaving me to understand that only by looking at what a person is using his personal allocation of time doing can you establish a value. Of course that value would fluctuate greatly when viewed by others because of the many different opinions.
I'd say I've spent all the time I'm going to on this but how can you spend something that has no value. Then again, bridges are of value and a lot of my time is used to bridge me from one value rated task to the next one. I can't think of the last one right now nor can I imagine what the next one might be but thanks to the bridge anyway. YUK! I just thought of the fact, it's a bridge between birth and death.

The tree is gone, the tree is gone and along with it a small piece of my pleasant mood. I asked the guy to cut a single branch off another tree which he said he would for another $20. I told him the limb wasn't a twenty dollar bother but did bother me some, maybe as much as half that. After some thought he agreed to the ten bucks. After finishing up the other tree removal he asked the boys not to pull the rope down because he was going to cut the limb for me. As they were cleaning stuff up Dory noticed the guy pulling the rope down with the limb we wanted gone still attached to the tree. I went out to see what the problem was and he flat told me he couldn't cut the limb for $10. Ticked me off clear to my eyeballs and I'm telling you just across my belly alone is one hell of a bunch of ticked! Whatever will be always ends up as is and I guess that limb removal must have been an ain't. Like a camera's flash, my ticked covered quite an area but didn't illuminate the anger for long. Happy will be, if one's mind wants it with enough strength. Priorities my love, priorities.
